1.3   Scope of personal data processing

In principle, we process the personal data of our users only insofar as this is necessary to provide a functioning website as well as our content and services. The processing of the personal data of our users takes place regularly only with the consent of the user. An exception applies to cases in which prior consent cannot be obtained for practical reasons and the processing of the data is permitted by law. 

1.4   Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for the processing of personal data, art. 6 para. 1 version a of the EU General Data Protection Regulation (GDPR) serves as the legal basis.

In the processing of personal data required for the performance of a contract of which the data subject is a party, art. 6 para. 1 version b of the GDPR serves as the legal basis. This also applies to processing operations required to carry out pre-contractual actions.

Insofar as processing of personal data is required for the performance of a legal obligation that is subject to our company, art. 6 para. 1 version c of the GDPR serves as the legal basis.

In the event that vital interests of the data subject or any other natural person require the processing of personal data, art. 6 para. 1 version d of the GDPR serves as the legal basis.

If processing is necessary to safeguard the legitimate interests of our company or a third party, and if the interest, fundamental rights and freedoms of the data subject do not outweigh the former interest, art. 6 para. 1 version f of the GDPR serves as the legal basis for the processing.

 

1.5   Data erasure and storage duration

The personal data of the data subject will be deleted or blocked as soon as the purpose of the storage shall no longer apply. Furthermore, such storage may take place if it is stipulated by the European or national legislator in EU regulations, laws or other regulations to which the responsible person is subject. Blocking or deletion of the data also takes place if a storage period prescribed by the standards mentioned expires, unless there is a need for further storage of the data for the conclusion of a contract or fulfilment of the contract.

 

2)   Data collection when visiting our website

In the case of merely informative use of our website, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to our server (so-called "server log files"). When you access our website, we collect the following information that is technically necessary for us to display the website:

The processing is carried out in accordance with art. 6 para. 1 version f of the GDPR based on our legitimate interest in improving the stability and functionality of our website. The data is only transferred for the operation of the website and the maintenance of system security only within the ADLER Business Group (ADLER-Werk Lackfabrik, Bergwerkstraße 22, 6130 Schwaz) on the basis of our legitimate interest (art. 6 para. 1 version f of the GDPR) instead of running our services cost-effectively. A transfer to third parties or other use of the data does not take place. However, we reserve the right to retrospectively check the server log files should concrete evidence point to unlawful use. 

 

3)   Cookies

In order to make your visit to our website attractive and to enable the use of certain functions, we use cookies on various pages. These are small text files that are stored on your terminal device. Some of the cookies we use are deleted after the end of

the browser session, thus after closing your browser (so-called session cookies). Other cookies remain on your terminal device and allow us or our partner companies (third-party cookies) to recognise your browser on your next visit (persistent cookies). If cookies are set, they collect and process certain user information such as browser and location data as well as IP address values on an individual basis. Persistent cookies are automatically deleted after a specified period, which may differ depending on the cookie.

Insofar as personal data is also processed by individual cookies implemented by us, the processing is carried out in accordance with art. 6 para. 1 version b of the GDPR either for the execution of the contract or in accordance with art. 6 para. 1 version f of the GDPR for safeguarding our legitimate interests in the best possible functionality of the website as well as a customer-friendly and effective design of the page visit.

Under certain circumstances we work with advertising partners to help us make our Internet offer more interesting to you. 4)   Contacting

When you make contact with us (for example via contact form or email), personal data is collected. The data collected in the case of a contact form can be seen from the respective contact form. This data is stored and used solely for the purpose of answering your request or for making contact and the associated technical administration. The legal basis for processing the data is our legitimate interest in answering your request in accordance with art. 6 para. 1 version f of the GDPR. If your contacting is aimed at concluding a contract, then additional legal basis for the processing is art. 6 para. 1 version b of the GDPR. Your data will be deleted after final processing of your request, this is the case if it can be inferred from the circumstances that the matter in question is finally clarified and provided that no statutory storage requirements are in conflict. The user has the possibility at any time to revoke his consent to the processing of the personal data. 

 

5)   Use of your data for direct marketing

5.1   Subscribing to our email newsletter

If you subscribe to our email newsletter, we will send you regular information about our products and offers. The only mandatory information required to send the newsletter is your email address. The disclosure of further possible data is voluntary and will be used to address you personally. To send the newsletter we use the so-called double opt-in process. This means that we will only send you an email newsletter if you have explicitly confirmed to us that you agree to the sending of the newsletter. We will then send you a confirmation email asking you to confirm by clicking on a corresponding link that you wish to receive newsletters in the future.

By activating the confirmation link, you give us your consent to the use of your personal data in accordance with art. 6 para. 1 version a of the GDPR. When subscribing to the newsletter, we will save your IP address entered by the Internet Service Provider (ISP) as well as the date and time of registration in order to be able to trace a possible misuse of your email address at a later date. The data collected by us when registering for the newsletter will be used exclusively for promotional purposes by means of the newsletter. You can unsubscribe from the newsletter at any time using the link provided in the newsletter or by sending a message to the above-mentioned responsible person. Following successful cancellation, your email address will be immediately deleted from our newsletter mailing list, insofar as you have not expressly consented to a further use of your data or we reserve the right to further data usage, which is permitted by law and about which we inform you in this declaration.

5.2   Newsletter dispatch via CleverReach

Our email newsletter is sent via the technical service provider CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede ("CleverReach"), to which we pass on your data provided during the newsletter registration. This transfer is made in accordance with art. 6 para. 1 version f of the GDPR and serves our legitimate interest in the use of a promotional, secure and user-friendly newsletter system. The data entered by you for the purpose of receiving a newsletter (e.g. email address) will be stored on the servers of CleverReach in Germany or Ireland.

CleverReach uses this information for sending and statistical evaluation of the newsletter on our behalf. For the evaluation, the emails sent include so-called web beacons or tracking pixels, which represent one-pixel image files stored on our website. In this way it is possible to determine whether a newsletter message has been opened and which links have been clicked on, if necessary. With the help of the so-called conversion tracking it can also be analysed whether after clicking on the link in the newsletter a predefined action (e.g. purchase of a product on our website) has taken place. In addition, technical information is collected (e.g. time of retrieval, IP address, browser type and operating system). The data will be collected exclusively pseudonymised and will not be linked to your other personal data, a direct personal reference is excluded. This data is exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipient.

If you want to object to the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.

We have entered into a contract processing agreement with CleverReach, in which we commit CleverReach to protect our customers' data and not to disclose it to third parties.

5.3   Advertising by mail 

Based on our legitimate interest in personalised direct marketing, we reserve the right to store your first and last name, postal address and, if we have received this additional information from you as part of the contractual relationship, your title and your business name in accordance with art. 6 para. 1 version f of the GDPR and use them for sending interesting offers and information about our products by mail.

You can object to the storage and use of your data for this purpose at any time by sending a message to the responsible person.

  

6)   Use of Social Media: Videos

Use of Youtube videos

This site uses the Youtube embedding feature to display and play videos from "Youtube", which is owned by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Here, the extended data protection mode is used, which according to the provider information only initiates storage of user information during playback of the video(s). When the playback of embedded Youtube videos starts, the provider

"Youtube" uses cookies to collect information about user behaviour. According to "Youtube" hints, these are used, among other things, to capture video statistics, improve user-friendliness and prevent abusive practices. If you are logged in to Google, your data will be directly associated with your account when you click on a video. If you do not wish to associate with your profile on YouTube, you must log out before activating the button. Google stores your data (even for users not logged in) as usage profiles and evaluates them. Such an evaluation takes place in particular in accordance with art. 6 para. 1 version f of the GDPR based on the legitimate interests of Google in the display of personalised advertising, market research and/or needs-oriented design of its website. You are entitled to a right to object to the creation of these User Profiles, whereby you must address YouTube to exercise it.

Independent of any playback of the embedded videos, every time you visit this website, a connection to the Google Network "DoubleClick" is recorded, which may trigger further data processing operations without our having any influence.

7)   Online marketing

7.1   Use of Google AdWords Conversion Tracking

This website uses the "Google AdWords" online advertising program and, as part of Google AdWords, conversion tracking from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). We use the offer from Google Adwords to draw attention to our attractive offers with the help of advertising materials (so-called Google Adwords) on external websites. We can determine how successful the individual advertising measures are in relation to the data of the advertising campaigns. We are interested in showing you advertisements that are of interest to you, to make our website more interesting to you and to achieve a fair calculation of advertising costs.

The conversion tracking cookie is set when a user clicks on an ad placed by Google AdWords. Cookies are small text files that are stored on your computer system. These cookies usually lose their validity after 30 days and do not serve as personal identification. If the user visits specific pages of this website and the cookie has not yet expired, Google and we recognise that the user has clicked on the ad and has been redirected to this page. 10.2    Trusted Shops Trustbadge

To display our Trusted Shops seal of quality as well as to offer the Trusted Shops membership for buyers after placing an order, the Trusted Shops Trust Badge is included on this website.

This serves to safeguard our legitimate interests, which are predominantly justified in the context of a weighing up of interests, in the optimal marketing of our offer, art. 6 para. 1 version f of the GDPR. The Trustbadge and the services advertised are an offer of Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne.

When the Trustbadge is called up, the web server automatically stores a so-called server log file, which contains, for example your IP address, date and time of the call-up, amount of data transferred and the requesting provider (access data) and documents the call-up. This access data is not evaluated and is automatically overwritten within seven days after the end of your page visit.

Further personal data is only transferred to Trusted Shops, insofar as you decide after the conclusion of an order on the use of Trusted Shops products or have already registered for the use. In this case, the contractual agreement concluded between you and Trusted Shops applies.

The applicable data protection law grants you comprehensive data protection rights (information and intervention rights) vis-à-vis the responsible person with regard to the processing of your personal data, which we inform you about below:

-  Right to information in accordance with art. 15 of the GDPR: In particular, you have the right to information about the personal data processed by us, the processing purposes, the categories of processed personal data, the recipients or categories of recipients to whom your data was or is being disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right of rectification, deletion, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data, if it was not collected from you by us, the existence of automated decision-making including profiling and possibly meaningful information on the logic involved and the scope and intended impact of such processing, as well as your right to be informed, which guarantees exist in accordance with art. 46 of the GDPR in the case of transmitting of your data to third countries;

-  Right to rectification in accordance with art. 16 of the GDPR: You have the right to immediate correction of incorrect data concerning you and/or completion of your incomplete data stored by us;

-  Right to deletion in accordance with art. 17 of the GDPR: You have the right to demand the deletion of your personal data if the requirements of art. 17 para. 1 of the GDPR are met. However, that right does not apply, in particular, where the processing is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of rights;

-  Right to restriction of processing according to art. 18 of the GDPR: You have the right to demand the restriction of the processing of your personal data, as long as the correctness of your data, which is disputed by you, is checked, if you refuse deletion of your data due to inadmissible data processing and instead demand the restriction of the processing of your data, if you need your data for the assertion, exercise or defence of legal rights, after we no longer need this data after attainment of the purpose or if you have objected for reasons of your particular situation, as long as it is not certain, whether our entitled reasons predominate;

-  Right to be informed in accordance with art. 19 of the GDPR: If you have asserted the right to rectification, deletion or restriction of the processing to the responsible person, this person is obligated to inform all recipients, to whom the personal data relating to you has been disclosed, of this rectification or deletion of the data or restriction of the processing, unless this proves to be impossible or involves disproportionate effort. You have the right to be informed about these recipients.

-  Right to data portability in accordance with art. 20 of the GDPR: You have the right to receive your personal data provided to us in a structured, common and machine-readable format or to request transfer to another responsible person, as far as this is technically feasible;

-  Right of withdrawal of granted consent in accordance with art. 7 para. 3 of the GDPR: You have the right to revoke consent previously given to the processing of data at any time with effect for the future. In the case of withdrawal, we will delete the data concerned immediately, if further processing cannot be based on a legal basis for processing without consent. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the withdrawal;

-  Right to complain in accordance with art. 77 of the GDPR: If you consider that the processing of your personal data violates the GDPR, you have the right - without prejudice to any other administrative or judicial remedy - to complain to a supervisory authority, in particular in the Member State of your place of residence, your place of work or the place of the alleged infringement.

 

11.2    RIGHT OF OBJECTION

IF, IN THE CONTEXT OF A WEIGHING UP OF INTERESTS, WE PROCESS YOUR PERSONAL DATA BASED ON OUR PREDOMINANT LEGITIMATE INTERESTS, YOU HAVE THE RIGHT AT ANY TIME, FOR REASONS ARISING FROM YOUR SPECIFIC SITUATION, TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE.

IF YOU MAKE USE OF YOUR RIGHT OF OBJECTION, WE WILL TERMINATE THE PROCESSING OF THE AFFECTED DATA. FURTHER PROCESSING REMAINS RESTRICTED HOWEVER, IF WE CAN DEMONSTRATE REASONS WORTHY OF PROTECTION FOR THE PROCESSING WHICH OUTWEIGH YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FUNDAMENTAL FREEDOMS, OR IF THE PROCESSING SERVES THE ASSERTION, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US TO CONDUCT DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING AT ANY TIME. YOU MAY EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

IF YOU MAKE USE OF YOUR RIGHT OF OBJECTION, WE WILL TERMINATE THE PROCESSING OF THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.
